Licenses to Content and Content IP shall be only as set forth in the Transition Services Agreement, a Commercial Agreement or as otherwise may be agreed by the Parties.
Each Party’s indemnification obligations with respect to Data Breaches, Cybersecurity Incidents, and breaches of Article VI of this Agreement, or of the Data and Content Security Addendum, Data Processing Addendum or Digital Tech Addendum shall be governed by the terms and conditions set forth in the Data and Content Security Addendum.

Subject to the limitations on liability set forth in Section 3.4, in the event of a breach of Section 5.2 (Confidentiality – Use and Disclosure Limitations) by either Party (excluding a Data Breach or other Cybersecurity Incident), the non-breaching Party shall be entitled to recover its Damages from the breaching Party; provided that the liability cap for such breaches shall be the Enhanced Damages Cap (as defined in the Data and Content Security Addendum).
For clarity, no license to Content or Content IP is granted by either Party to the other Party pursuant to this Agreement.
