If any terms of the Complete Bar Order entered by the Court is held to be unenforceable after the date of entry, such provision shall be substituted with such other provision as may be necessary to afford each of the Releasees the fullest protection permitted by law from any Claim that is based upon, arises out of, or relates to any Released Securities Holder/Company Claim.
For the avoidance of doubt, any and all Insurance Claims are expressly preserved and are not barred or otherwise impacted by this Final Order and Judgment or the Complete Bar Order.
