Commodity Pool Operator definition

Commodity Pool Operator means any Person engaged by the Sponsor or the Trust who, in connection therewith, solicits, accepts, or receives monies or in-kind contributions for the purpose of trading in any commodity for future delivery or commodity option on or subject to the rules of any contract market for the benefit of the Trust.
Commodity Pool Operator means a “commodity pool operator” as defined in Section 1a(11) of the Commodity Exchange Act.
Commodity Pool Operator means a commodity pool operator, as defined under Section la(11) of the CEA, that is registered with the CFTC pursuant to Section 4m of the CEA and the rules and regulations thereunder.

Commodity Pool Operator as defined in Section 1(a)(11) of the Commodity Exchange Act and ““commodity trading advisor”” as defined in Section 1(a)(12) of the Commodity Exchange Act with the CFTC or (ii) with respect to the Borrower as the commodity pool, the Services Provider would be eligible for an exemption from registration as a commodity pool operator and commodity trading advisor and all conditions for obtaining the exemption have been satisfied.
