Collateral Receipt definition

Collateral Receipt has the meaning assigned to that term in the Custodial Agreement.
Collateral Receipt means a Custodian’s Acknowledgment in the form of Schedule A to the Custodian Agreement.
Collateral Receipt means an accurate description of the security given to an indemnitor by the receiving agency's agent, in its fiduciary capacity, listing all collateral given as security for a bail bond and held by the agency/agent until the bail bond is exonerated by the court or a forfeiture occurs. The receipt shall name the owner of the collateral, the defendant, and the bond number, and specify the terms for redemption of the collateral including any fees charged for storage.

Examples of Collateral Receipt in a sentence

  • Any collateral or other indemnity shall be returned to the person whose name appears as Depositor on the Collateral Receipt: (1) upon final termination of liability on the Bond, including the conclusion of all appeals or appeal periods, and when the obligation is discharged; and (2) all fees owed to the bail producer have been paid.

  • Collateral will be returned to the person whose name appears as Depositor on the Collateral Receipt within 21 days after proof of final termination of liability on the Bond has been provided to the Surety.

  • If a forfeiture occurs, the bail producer or Surety shall give the Defendant and the person whose name appears as Depositor on the Collateral Receipt 10 days’ written notice of intent to convert the collateral deposit into cash to satisfy the forfeiture.

  • If the obligation of the Surety on the Bond is released in writing by the court and a discharge is provided to the Surety or its agent, the collateral or other indemnity (except a promissory note, the Agreement or any other indemnity agreement) shall be returned to the person whose name appears as Depositor on the Collateral Receipt within 21 days after the discharge is provided (unless the Depositor provides the Surety a legal assignment of the right to receive the collateral).

  • If collateral received is in excess of the bail forfeited, such excess shall be returned to the person whose name appears as Depositor on the Collateral Receipt after the application of the collateral to the forfeiture and all amounts owed to Surety.
