Upon receipt of approval from the Servicer, the Collateral Agent or the Collateral Administrator shall transmit the same to the applicable Loan Party and shall make such reports available to the Administrative Agent, each Membership Interest Holder and each Lender.

The obligation of the Collateral Manager to furnish such information is subject to the Collateral Manager’s timely receipt of necessary reports and the appropriate information from the Person responsible for the delivery of or preparation of such reports and such information (including without limitation, the Obligors of the Collateral Obligations, the Rating Agency, the Trustee and the Collateral Administrator) and to any confidentiality restrictions with respect thereto.
