Nothing contained herein shall be deemed or operate to preclude the Collateral Agent or the Noteholders from bringing suit or taking other legal action against any Grantor in any other jurisdiction to collect on a Grantor’s obligations or to enforce a judgment or other court ruling in favor of the Collateral Agent or a Noteholder.
The Collateral Agent shall have no responsibility to receive or maintain in its possession any physical copies thereof.
If an Event of Default has occurred and is continuing at the time of such direction, the Collateral Agent, if so directed by the Requisite Lenders, shall disregard such direction.
The recitals herein are deemed to be those of the Company and the Guarantors and not of the Trustee and the Collateral Agent.
