The Facilitator may communicate among the team members (as deemed appropriate) including, but not limited to, communicating with each client individually or together, a client with his or her Collaborative lawyer present, each Collaborative lawyer individually, or together with the other Collaborative lawyer, and any other professionals retained by the clients who have signed a participation agreement in this matter.
Thus, while each party’s Collaborative lawyer is his or her advisor, counselor and advocate, the lawyer cannot go with the client to court in person, represent his or her client in any court proceeding, or be named or remain identified as a party’s lawyer of record on any document filed with the court.
Other practitioners have concluded that they may privately discuss with their clients the law and the role of the law in the Collaborative Process, but that they should first work out with the other Collaborative lawyer how this should be done in a way to further the Collaborative Process.

In the event an attorney or other professional discovers that another Collaborative lawyer or professional has made a misstatement of fact or law or a miscalculation, he or she shall inform the other lawyer or professional of the discovery and request disclosure and correction of the same.
