Co-Defendant definition

Co-Defendant means an Entity that is (i) named as a defendant in a lawsuit in which one or more of the Debtors is also named as a defendant, (ii) initiated a third-party claim against one or more of the Debtors in a lawsuit, (iii) initiated a cross-claim against one or more of the Debtors in a lawsuit, and/or (iv) alleged to be fully or partially responsible for a Tort Claim, including an Unknown Tort Claim asserted, or which may be asserted in the future, against such Entity, including co-debtors as described in Bankruptcy Code § 509.
Co-Defendant means an Entity that is named or could be named as a defendant in a lawsuit in which the Debtor is also named or could be named as a defendant and/or who is alleged to be fully, partially or jointly responsible for a Claim asserted or that could be asserted in the future against both such Entity and the Debtor, including a co-debtor as described in § 509. For purposes of this Plan, none of the Protected Parties is or shall be deemed to be a Co-Defendant.
Co-Defendant means a Person, other than a Shareholder-Affiliated Party, Physician, Health Insurer, Government Payor or Health Care Provider, who is named and/or aligned as a co-defendant with the Debtor in any legal proceeding in any way relating to a Breast Implant, a Non-Dow Corning Breast Implant, or Other Product, including, without limitation, Baxter Healthcare Corp., Baxter International, Inc., Minnesota Mining & Manufacturing Co., and Bristol-Myers Squibb Company.

  • If the claimant makes such an election, any other nonbankrupt Co-Defendant(s) that went to judgment shall receive a set-off pursuant to subsection 3(d)(ii)(A) above, except that a nonbankrupt Co-Defendant which had previously paid the judgment or entered into a post-judgment settlement prior to the plaintiff's revised election shall retain its rights to make a Contribution Claim against the Trust under subsection 4, below.
