Within 90 days after the occurrence of an Event of Default that has not been corrected or waived, unless authorized by the Securities and Exchange Commission, the Indenture Trustee will resign for the Class A, Class B, Class C and/or Class D Notes according to Section 6.8, and the Issuer will appoint a successor Indenture Trustee for the Class A, Class B, Class C and/or Class D Notes, as applicable, so that there will be separate Indenture Trustees for the Class A, Class B, Class C and Class D Notes.
Simultaneously with the issuance and sale of the Offered Notes as contemplated in this Agreement, the Trust will issue the Class C Notes (the "Class C Notes") and Class D Notes (the "Class D Notes" and, collectively with the Class C Notes and the Offered Notes, the "Notes").
The Class C Notes and Class D Notes will initially be retained by the Depositor.
If a successor Indenture Trustee is appointed for the Class A, Class B, Class C or Class D Notes under this Section 6.11, the Issuer, the predecessor Indenture Trustee and the successor Indenture Trustee will execute an indenture supplemental to this Indenture.
