Clarity Note definition
Clarity Note. For the purposes of clarity, this bargaining unit excludes the Marketing Person for the Occupational Health Program and includes Nurses in the Shift Nursing program. The Employer recognizes the Ontario Nurses’ Association as the bargaining agent of all Registered and Graduate Nurses employed in a nursing capacity by the Victorian Order of Nurses – Ontario Branch, Thunder Bay and District Site, in the Districts of Thunder Bay, Kenora and Rainy River, save and except Managers and persons above the rank of Manager.
Clarity Note. For the purpose of clarity, the parties agree that the Manager, Pharmacy Service and the Manager, Food & Nutrition Services are excluded from the bargaining unit. The parties further agree that students hired to work over the summer period are also excluded from the bargaining unit.

Clarity Note. For the purpose of the above bargaining-Association description, a supervisor will be excluded from the bargaining unit if she/he exercises managerial functions, as per subsection 1(4) of the Labour Relations Act, 1995.
Clarity Note. For the purpose of clarity, office and clerical staff, community support workers, research assistants, clinical director, director of education, attending physicians and psychiatrists are excluded from the bargaining.

For clarity, a person who works less than a full year and receives vacation pay as a lump sum shall not be considered as in receipt of vacation for the purpose of this clause.
Clarity Note. If a nurse picks a single or multiple shifts in a 1 week period this counts as 1 week of vacation entitlement for the summer period. This does not limit others from requesting single or multiple shifts which may be available in the same week.
