The Clean Energy Results Program (CERP) is an innovative initiative that integrates goals for creating sources of renewable energy and encouraging energy-efficient development with MassDEP’s permitting and assistance functions.
Nevertheless, in the event of any inconsistency between the provisions of the CERP Manual, the Crisis Response Plan(s), or the CERP ESCP, on the one side, and any provision of these General Conditions or the Legal Agreements, on the other, the provisions of the Legal Agreements and these General Conditions shall prevail.
To this end, the Recipient: (a) shall carry out the Project in accordance with the provisions of Article V of the General Conditions and Schedule 2 to this Agreement; and (b) shall carry out, or cause to be carried out, the CERP in accordance with Article V of the General Conditions.
