Catastrophic Failure definition

Catastrophic Failure means any failure of any piece of Key Equipment where (i) such failed Key Equipment has been maintained in accordance with Good Utility Practice and all other applicable requirements of this Agreement in all material respects, and (ii) such failure cannot reasonably be expected, in accordance with Good Utility Practice, to be corrected within three (3) months after the occurrence of such failure by Seller using commercially reasonable efforts in accordance with Good Utility Practice.
Catastrophic Failure means a sudden and unexpected failure of any part of the Electricity Supply System which renders the Electricity Supply System in whole or in part economically or technically unfit to operate;
Catastrophic Failure means a sudden and unexpected failure of one or more generating units that form part of the generating facilities which renders that or those units economically or technically unfit to generate;

  • If a Catastrophic Failure occurs due to swings in daily weather conditions then the Supplier will extend its warranty to repair such failures subject to adjustment for normal wear and tear and depreciation.
