Neither Trustor nor any tenant or other person shall remove, demolish or alter any improvement now existing or hereafter erected on the Property or any fixture, equipment, machinery or appliance in or on the Property except when incident to the replacement of fixtures, equipment, machinery and appliances with items of like kind; provided however, that Trustor may make non-structural alterations to the Property or improvements thereon to the extent permitted by the Casino Lease.
Subject to the rights of Trustor under the Casino Lease, Beneficiary may make or cause to be made reasonable entries upon and inspections of the Property (including, but not limited to, phase I and/or phase II environmental audits and inspections).
All capitalized terms used herein and not otherwise defined shall have the meanings ascribed to them in the Casino Lease.
As of the date hereof, Tenant has no knowledge of any event which, but for the passage of time or the giving of notice or both, would constitute an event of default by either Landlord or Tenant under the Casino Lease or Security Agreement.
Except as otherwise herein expressly provided, the Casino Lease shall continue in full force and effect, as amended by this Amendment.
