Examples of Case Professionals in a sentence
Neither the DIP Agents, the DIP Secured Parties nor the Prepetition Secured Parties shall be responsible for the payment or reimbursement of any fees or disbursements of any Case Professionals incurred in connection with the Chapter 11 Cases or any Successor Cases under any chapter of the Bankruptcy Code.
Nothing in this Interim Order or otherwise shall be construed to obligate the DIP Agents, DIP Secured Parties or Prepetition Secured Parties in any way to pay compensation to or to reimburse expenses of any Case Professionals, or to guarantee that the Debtors have sufficient funds to pay such compensation or reimbursement.
No fee may be paid from the Pro Fee Account until it has been authorized and approved by the Bankruptcy Court, whether approved on an interim or final basis or paid in accordance with any order of the Bankruptcy Court governing the payment of Case Professionals.
So long as there are no Events of Defaults under this Agreement, budgeted amounts for the Case Professionals will be transferred each week pursuant to the Budget into a segregated account (the “Pro Fee Account”) that is not subject to the Lender’s liens or security interests.
Lender shall not be responsible for the direct payment or reimbursement of any fees or disbursements of any Case Professionals incurred in connection with the Chapter 11 Case under any chapter of the Bankruptcy Code, and nothing herein shall be construed to obligate Lender in any way to pay compensation to or to reimburse expenses of any Case Professional, or to guarantee that Borrower have sufficient funds to pay such compensation or reimbursement.
