Capital Investments definition
Capital Investments at any time means an amount net of the amount of Government Funded Benefit refunds as provided in section 7, not exceeding the lesser of:
i. the value of the Plan Assets at that particular time; and
ii. the aggregate of all Contributions made to the Plan up to that time eligible for refund at that time under the Applicable Legislation;
Capital Investments are defined and identified in the Resolution under Section 3(b).

Capital Investments means (without duplication), with respect to any Person for any period, the aggregate of all investments by such Person in (i) Capital Expenditures, (ii) joint ventures, general or limited partnerships, limited liability companies or any other type of Person that is not a Subsidiary, including loans and advances to such Person (including loans and advances to any physician group or other third party related to a Facility or Related Business, or any third party with whom such Person has entered into a Service Agreement), (iii) capital investments in, and loans and advances to, a Subsidiary which becomes a Subsidiary as a result of such investment, (iv) the purchase of the homes of employees of such Person in connection with the relocation of such employees, and (v) Existing Clinic Acquisitions.
Capital Investments means expenditures
Capital Investments means an investment by or on behalf of the Company for the Project on or after January 1, 2023, but prior to July 1, 2050, by purchase or lease, in real property, tangible personal property, or both, at a facility that is properly chargeable to a capital account or would be so chargeable with a proper election.
