CapEx Loan Commitment definition

CapEx Loan Commitment means an amount equal to $10,000,000, it being understood and agreed that in no event shall the aggregate principal amount of all CapEx Loan advances made by the Bank from time to time exceed $10,000,000.

CapEx Loan Commitment means an amount equal to One Million Five Hundred Thousand and No/100 Dollars ($1,500,000.00) for the Capex Facility.

CapEx Loan Commitment means (a) as to any Lender, the commitment of such Lender to make CAPEX Advances as set forth on the signature page of this Agreement opposite such Lender's signature or in the most recent Lender Addition Agreement, if any, executed by such Lender and (b) as to all Lenders, the aggregate commitment of all Lenders to make CAPEX Advances.

• If any Default or Event of Default has occurred and is continuing, Agent may (and at the written request of the Requisite CapEx Lenders shall), without notice, suspend the CapEx Loan Commitment with respect to additional CapEx Advances, whereupon any additional CapEx Advances shall be made or incurred in Agent's sole discretion (or in the sole discretion of the Requisite CapEx Lenders, if such suspension occurred at their direction) so long as such Default or Event of Default is continuing.

CapEx Loan Commitment means, with respect to each Capex Loan Lender, the commitment to make Capex Loans to the Borrower pursuant to Section 2.2 of this Agreement, in an aggregate principal amount at any one time outstanding not to exceed the amount set forth opposite such Capex Loan Lender’s name on Schedule 2.1 attached to this Agreement under the heading “Capex Loan Commitment” or in the Assignment and Assumption pursuant to which such Capex Loan Lender becomes a party hereto, as applicable, as such amount may be adjusted from time to time in accordance with this Agreement, including pursuant to Section 2.8.

CapEx Loan Commitment means, as to any Lender, the obligation of such Lender to make its CapEx Loan prior to the CapEx Loan Commitment Termination Date in the principal amount not to exceed the amount set forth opposite such Lender’s name on Schedule 1 attached hereto and made a part hereof. The CapEx Loan Commitments of the Lenders aggregate $10,000,000 on the Restatement Effective Date.
