Brokering Services means the recruitment of individuals to participate in training that is to be subsidised under this VET Funding Contract, by an individual or organisation in exchange for payment from the Training Provider or the student, but excludes activities carried out by salaried individuals who are employees of the Training Provider whose role includes the identification and recruitment of potential students.

Brokering Services means:

Brokering Services means where an individual or organisation receives payment from the RTO in exchange for recruiting individuals to participate in government subsidised training. This does not include salaried individuals who are employees of the RTO whose primary purpose is the identification and recruitment of potential students.

• The Training Provider must provide the Department, in a format to be determined by the Department from time to time, with details of all third party arrangements for the delivery of Brokering Services on the Training Provider’s behalf within 30 days of the Commencement Date of this VET Funding Contract, and thereafter within 30 days of entering into any such further arrangement.

• This information must be kept up to date and include the following caveat: ‘The student tuition fees as published are subject to change given individual circumstances at enrolment’; details of any other fees including student services, amenities, goods or materials; a list of all providers of Brokering Services used by the Training Provider; and the Training Provider’s online service standards as prescribed by the Department from time to time.

• To avoid doubt, it is considered to be subcontracting to engage: an individual through a franchise, labour hire or other similar arrangement; or any person to undertake Brokering Services.

• Reporting of subcontract arrangements for Brokering Services The Training Provider must provide the Department, in a format determined by the Department, details of each subcontract arrangement it has entered into for the delivery of Brokering Services as follows: details of any subcontract arrangements entered into prior to the Commencement Date, within 30 days of the Commencement Date; and details of any further subcontract arrangement, within 30 days of entering into that arrangement.

• This may include but is not limited to: determination of eligibility and enrolment processes, Pre-Training Reviews, marketing, and Brokering Services.
