The New York State General Municipal Law Article 18-C, S-970-c defines "Blighted area" as an area within a municipality in which one or more of the following conditions exist: (i) a predominance of buildings and structures which are deteriorated or unfit or unsafe for use or occupancy; or (ii) a predominance of economically unproductive lands, buildings or structures, the redevelopment of which is needed to prevent further deterioration which would jeopardize the economic well-being of the people.
Section 311.002, Tax Code, is amended by amending Subdivision (1) and adding Subdivision (1-a) to read as follows: (1) "Blighted area" has the meaning assigned by Section 374.003, Local Government Code.
In order for an activity to meet the National Objective of Slums and Blight, the activity must take place in an area that meets the definition of a Blighted area and the project must be shown to eliminate Blight or prevent further Blight per Federal Regulation 24 CFR, Part 570.483(c).
