Beta Software means any version of Software prior to a generally available commercial release of such Software.
Beta Software means any Software that has been designated as a non-production version, including software labeled as “beta,” “pre-release,” or “candidate.”

Except for the provisions of Section 5(a), (b) and (c) and Section 6 of this EULA, which shall not apply with respect to any Beta Software, User acknowledges and agrees that all Beta Software delivered in accordance with this paragraph shall be considered to be “Software” for all purposes of this EULA.
