Examples of Bankruptcy Event in a sentence
The Servicer shall notify the Administrative Agent within two (2) Business Days of its knowledge of the occurrence of any payment default in principal or interest by an Obligor under any Eligible Loan Asset or any Bankruptcy Event with respect to any Obligor under any Loan Assets.
The Borrower shall give, or shall cause the Servicer to give, notice to the Administrative Agent within two Business Days of the Borrower’s, the Transferor’s or the Servicer’s actual knowledge of the occurrence of any payment default in principal or interest by an Obligor under any Loan Asset or any Bankruptcy Event with respect to any Obligor under any Loan Asset.
Each of the parties hereto (other than the Administrative Agent with the consent of the Required Lenders) agrees that it will not institute against, or join any other Person in instituting against, the Borrower any proceedings of the type referred to in the definition of Bankruptcy Event so long as there shall not have elapsed one year and one day (or such longer preference period as shall then be in effect plus one day) since the Collection Date.
Accrued and unpaid Interest, if any, shall also be payable by way of inclusion of such Interest in the Conversion Amount (as defined below) on each Conversion Date (as defined below) in accordance with Section 3(b)(i) or upon any redemption in accordance with Section 14 or any required payment upon any Bankruptcy Event of Default (as defined below).
The Borrower is not the subject of any Bankruptcy Proceedings or Bankruptcy Event.
