The Owner represents and warrants to the Developer that a true, accurate and complete copy of the Architectural Contract is attached hereto as Exhibit "H" (the "Architect's Contract").
At the Developer's option, the Owner shall assign to the Developer all of its right, title and interest in the Architect's Contract and any and all architectural, engineering and other contracts with respect to the Project free of any claims other than outstanding amounts owed under the Architect's Contract.
Borrower shall have furnished in form and substance satisfactory to Lender an executed copy of the Architect's Contract and an executed copy of the Construction Contract.
