Operator shall submit to Tacoma Power, as of the Effective Date, and on an annual basis on the Annual Reporting Date, a report in a form reasonably acceptable to Tacoma Power, demonstrating Operator’s financial health and Operator’s ability to pay the IRU Fee and all other ongoing financial obligations associated with this IRU Agreement.
Unless otherwise specified in this IRU Agreement or Exhibits, Operator shall submit the Annual Report on the Annual Reporting Date.
