Annual Certification. As defined in Section 3.16(b) herein.

Annual Certification means the document issued annually to an Applicant certifying to the Tax Division the amount of the Tax Credit and taxable year in which such credit may be claimed, and such other information deemed appropriate by the Corporation.

Participant shall be required to promptly, timely, truthfully and fully complete such Annual Certification and to certify that such answers are true and correct to Participant’s knowledge; and the Company, the Advisor, the Manager and the applicable Plan Related Party shall treat information provided by the Participant pursuant to the Company’s whistleblower policies.
