Any amendment or modification of the commitments and reservations in accordance with this Article shall be subject to the procedures prescribed in Annex 3 (Procedures for Amendment or Modification of Reservations).
The Programme Operator shall comply with Article 3.3 of the Regulation, the Information and Communication Requirements in Annex 3 of the Regulation and the Communication plan for the programme.
The following documents shall be inserted as Annexes to this Schedule as soon as they have been developed and agreed by the Parties: Annex 1: the initial Release Plan developed for this Release; Annex 2: the Stories which are to form the subject of this Release; Annex 3: the current Product Backlog; and Annex 4: High Level Objectives for the Release The Parties agree that the Key Personnel in respect of this Project are detailed in the table at paragraph 43.2 below.
Such request shall be made pursuant to an Availability Certificate in the form of Annex 3 hereto executed by your Authorized Officer and delivered by you to us for an amendment to this Letter of Credit in the amount set forth in such Availability Certificate, which amount shall not exceed the Stated Amount less any amounts drawn under this Letter of Credit at or before the time of submission of such Availability Certificate, and expiring on the then current Expiration Date.
Any assignment and/or waiver under this sub-clause shall be on NICE's standard terms set out in Annex 3.
