Examples of Amendment No. 2 Effective Date in a sentence
The rights and obligations of the parties hereto shall be governed (i) prior to the Amendment No. 2 Effective Date, by the Existing Credit Agreement and (ii) on and after the Amendment No. 2 Effective Date, by this Amendment and the Amended Credit Agreement.
From and after the Amendment No. 2 Effective Date, (i) each reference in the Existing Credit Agreement to “this Agreement”, “hereunder”, “hereof”, “herein”, or words of like import, and each reference to the Existing Credit Agreement in any other Loan Document shall be deemed a reference to the Amended Credit Agreement.
Subject to the satisfaction (or waiver) of the conditions set forth herein, and immediately upon the Amendment No. 2 Effective Date, the Existing Credit Agreement (but not the exhibits or schedules thereto) shall be amended to delete the stricken text (indicated textually in the same manner as the following example: stricken text) and to add the double-underlined text (indicated textually in the same manner as the following example: double-underlined text) as set forth on Exhibit A hereto.
The Agent shall have received a counterpart signature page of this Amendment duly executed by (x) the Borrower and (y) each Lender under the Existing Credit Agreement as of immediately prior to the Amendment No. 2 Effective Date.
Once the Amendment No. 2 Effective Date has occurred, all references to the Existing Credit Agreement in any document, instrument, agreement, or writing shall be deemed to refer to the Amended Credit Agreement.
