Amended Declaration definition

Amended Declaration means the Amended and Restated Declaration of Trust of the Issuer Trust referred to in the recitals to this Guarantee Agreement, as modified, amended or supplemented from time to time.

Amended Declaration means this Amended and Restated Declaration of Trust, as the same may be modified, amended or supplemented in accordance with the applicable provisions hereof, including (i) all exhibits, and (ii) for all purposes of this Amended Declaration and any such modification, amendment or supplement, the provisions of the Trust Indenture Act that are deemed to be a part of and govern this Amended Declaration and any such modification, amendment or supplement, respectively.

Amended Declaration means the Amended and Restated Declaration of Trust, dated as of March 30, 2007, among the Company, as Depositor, Wilmington Trust Company, as the Property Trustee and the Delaware Trustee, and the Administrative Trustees.

• The provisions of Article VI of the Amended Declaration concerning meetings of the Holders shall apply to the giving of such approval.

• In case any provision in this Amended Declaration or in the Trust Securities Certificates shall be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.

Amended Declaration means the Amended and Restated Declaration of Trust, dated as of April 27, 2007, among the Company, as Depositor, Deutsche Bank Trust Company Americas, as the Property Trustee, Deutsche Bank Trust Company Delaware, as the Delaware Trustee, and the Administrative Trustees named therein.

Amended Declaration means and refer to each and every instrument recorded in the Official Public Records of Lubbock County, Texas which amends, supplements, modifies, clarifies or restates some or all of the terms and provisions of this Declaration.

Amended Declaration means this instrument, together with those exhibits which are attached hereto and made a part hereof and shall include such amendments, if any, as may be adopted from time to time pursuant to the terms hereof. This Amended Declaration may be referred to herein or in any other documents as the “ACACIA ASSOCIATION DECLARATION OF PROTECTIVE COVENANTS” or as the “PROTECTIVE COVENANTS”.

Amended Declaration means this Amended Declaration of Trust as amended from time to time. Reference in this Amended Declaration of Trust to "Declaration" "hereof", "herein" and "hereunder" shall be deemed to refer to this Amended Declaration rather than the article or section in which such words appear.

Amended Declaration means and refer to a separate instrument filed of record with the County Recorder that annexes and subjects Additional Land to this Declaration and may grant additional covenants, conditions, restrictions and easements as to such Additional Land, or otherwise makes amendments to this Declaration.
