AMCI also includes any and all of its directly and indirectly held subsidiaries, except where the context indicates to the contrary; provided, however, that for purposes of Section 3.9, the term "AMCI" further includes any corporation, trade, business or entity under common control with AMCI within the meaning of Section 414(b), (c), (m) or (o) of the Code or Section 4001 of ERISA.
