Amazon Site means, as applicable, the CA Amazon Site, the JP Amazon Site, the MX Amazon Site, or the US Amazon Site. "Amazon Transaction Information" means, collectively, Order Information and any other data or information acquired by you or your Affiliates from Amazon, its Affiliates, or otherwise as a result of this Agreement, the transactions contemplated by this Agreement, or the parties' performance under this Agreement.

• Any replacement Unit shipped by us under these FBA Service Terms will be deemed to be, and will be treated in the same manner as, an order and sale of such Unit from you to the customer via the applicable Amazon Site or Service in accordance with, and subject to, the terms and conditions of this Agreement and your Seller Agreement.

• If you offer a product for sale on an Amazon Site that requires a warning under California Health & Safety Code Section 25249.6 (a “Proposition 65 Warning”) you (a) will provide us with such warning in the manner specified in our Program Policies, (b) agree that our display of a Proposition 65 Warning on a product detail page is confirmation of our receipt of that warning, and (c) will only revise or remove a Proposition 65 Warning for a product when the prior warning is no longer legally required.

• You will provide accurate and complete Required Product Information for each product or service that you offer through any Amazon Site and promptly update that information as necessary to ensure it at all times remains accurate and complete.

• We will not be liable to you: (i) if we do not proceed with a transaction or disbursement that would exceed any limit established by us for a security reason, or (ii) if we permit a customer to withdraw from a transaction because an Amazon Site or Service is unavailable following the commencement of a transaction.

For the avoidance of doubt and without limiting the generality of the foregoing, Amazon Site does not include (A) any existing or future Affiliate websites principally serving geographic regions outside of the Territory (e.g., ▇▇▇.▇▇▇▇▇▇.▇▇), (B) any existing or future affiliated websites principally serving the Territory but operating under a separate url (e.g., ▇▇▇.▇▇▇▇▇▇.▇▇▇), or (C) any existing or future websites owned by Amazon or its Affiliates and hosted on ▇▇▇.▇▇▇▇▇▇.▇▇▇ but designated with a distinct third level domain name (e.g., ▇▇▇.▇▇▇.▇▇▇▇▇▇.▇▇▇); provided that (i) Amazon may not create or use a distinct third level domain name website for the purpose of offering a Short-Term Installments Product or a Long-Term Installments Product to consumers who have an account on ▇▇▇▇▇▇.▇▇▇ to circumvent Section 8.1 of this Agreement and (ii) in the event Amazon launches and makes available to consumer customers in the Territory a new distinct third level domain name website for the sale of general merchandise goods, and the annual sales by such third level domain name website are in excess of [***] as defined and disclosed in Amazon’s public filings of the same period, such third level domain name website will be included in the definition of Amazon Site for the purposes of Section 8.1 of the Agreement.
