AllStar and Deutsche Financial Services Corporation ("DFS") are parties to that certain Agreement dated as of August 5, 1996 (the "Agreement", capitalized terms used but not defined herein shall have the meanings given to them in the Agreement). The terms "character" and "Xxxx" shall be held to mean the actual animated superhero cartoon/ comic book character based on Xxxx, "The Mailman Xxxxxx as jointly developed by AllStar Arena Entertainment, Xxxx Xxxxxx and Xxxx Xxxxxx Properties, Inc., Xxxx Xxxxxx Properties, Inc. will retain the right to Player's name, likeness, image, nickname, trademarks etc. Xxxx Xxxxxx Properties, Inc., grants to AllStar the right to use Player's name, likeness, image, nickname, for the purpose of developing the Character and Xxxx XxXxxxx the term of this Agreement.
