The New Mexico Economic Development Department (“NMEDD”) and the Treasury Department have entered into that certain State Small Business Credit Initiative Allocation Agreement for Participating States dated October 11, 2011 (as amended or supplemented, the “Allocation Agreement”).
In addition, pursuant to the Allocation Agreement (in particular, Annex 1 thereto), the State of New Mexico, through the NMEDD, has applied to the NMFA to administer the LPP, and as such, the NMFA is required to comply with Articles IV and VI of the Allocation Agreement and has the rights of the State of New Mexico under Articles IV and VI of the Allocation Agreement.
