Agency error definition

Agency error means medical assistance incorrectly paid to or for the client because of action attributed to the department as the result of one or more of the following circumstances:
Agency error means a person or persons received benefits to which they were not entitled as a result of an error on the part of an eligibility worker at a local department of social services or the central processing unit.
Agency error in overpayments means: (a) The same as circumstances described in 441—subrule 45.24(1) pertaining to underpayments, or (b) any error that is not a client or procedural error.

  • For overpayments not caused by Agency error, payment may be collected or recouped in full immediately where possible.

  • In the event the Vendor credits an account in error due to causes other than Agency error or otherwise misappropriates LIHWA Payments, the Vendor must correct the error within thirty (30) days of the error’s discovery and is responsible for any applicable late charges, interest, or other penalties that cannot be waived in good faith.
