Actively Employed definition

Actively Employed. – means the employee has been at work and performing assigned duties for at least 80 percent of the work days over the previous 12 months.

Actively Employed means only the period during which the Employee is employed by the Employer performing the Employee’s customary duties for the Employer and the minimum period of notice of termination prescribed by the ESA (if any), and without regard to whether the Employee continues to receive compensatory payments beyond the last day the Employee perform the Employee’s customary duties for the Employer or are paid salary in lieu of notice of termination. For greater certainty, “Actively Employed” excludes any contractual or common law entitlement to any period of notice or pay in lieu of notice in excess of the Employee’s minimum statutory entitlements under the ESA.

Actively Employed means the period during which the Participant performs work for the Company or its Subsidiaries. “Actively Employed” shall be deemed to include (A) any period of paid time off or other approved leave of absence, and (B) if applicable, any period constituting the minimum notice of termination period that is required to be provided to the Participants pursuant to the Ontario Employment Standards Act, 2000 as amended from time to time (“ESA”). For the avoidance of doubt, “Actively Employed” shall be deemed to exclude any other period that follows or ought to have followed the later of (x) the end of the applicable ESA notice period or (y) or the last day that the Participant performs work for the Company or its Subsidiaries (including any period of paid time off or approved leave of absence), whether that period arises from a contractual or common law right.

Examples of Actively Employed in a sentence

Employee must be Actively Employed (as defined below) on the date any Bonus is paid in order to be eligible to receive such Bonus, unless otherwise expressly required by the ESA in which case there shall be no further entitlements beyond the Employee’s minimum statutory entitlements.
If you are not Actively Employed for the entire 30 day period, Restricted Cover will continue until you have been Actively Employed for 30 consecutive days.If on or prior to the Recommencement Date, you have been diagnosed with a terminal illness or you have claimed or are eligible to receive a benefit in relation to terminal illness or total and permanent disablement cover from any source, your recommenced cover will be Restricted Cover.
If, for any reason, you cease to be Continuously and Actively Employed with the Company prior to the Resignation Date, no Retention Bonus will be paid under this Agreement.
In order to be eligible to exercise a Purchase Right and to purchase Shares, the Participant must be Actively Employed by the Company or a Related Corporation on the applicable Purchase Date; r.
In the event the a covered Employee temporarily ceases to be Actively Employed due to an unpaid employer- approved leave of absence, coverage will continue in place for a period of thirty (30) days or until the Employee’s return to Active Employment.

For purposes of this Plan, except as may be required to comply with minimum requirements of applicable employment standards legislation, a Participant is not Actively Employed if his or her employment has been terminated by the Participant’s resignation or by the Corporation or a Subsidiary, regardless of whether the Participant’s employment has been terminated with or without Cause, lawfully or unlawfully or with or without notice, and, except as may be required by minimum requirements of applicable employment standards legislation, being Actively Employed does not include any period during, or in respect of, which a Participant is receiving or is entitled to receive payments in lieu of notice (whether by way of lump sum or salary continuance), benefits continuance, severance pay, damages for wrongful dismissal or other termination related payments or benefits, in each case, whether pursuant to statute, contract, common law, civil law or otherwise;

Actively Employed means the period during which you actually perform work for the Company or its Affiliates, which shall be deemed to include: (i) any period of vacation, paid time off or approved leave of absence; and (ii) any period constituting the minimum notice of termination period that is required to be provided to you, if any, pursuant to the employment standards legislation that is applicable to you (if any), but shall exclude any other period, including any period of reasonable notice at common law, that follows or ought to have followed the later of: (A) the end of such minimum statutory notice period; or (B) your last day of performing work for the Company and its Affiliates (including any period of paid time off or approved leave of absence), whether arising from a contractual or common law right;

Actively Employed means that the employee is a current employee of the Company.

Actively Employed means actively employed by the Company, including on a leave of absence other than a bridge leave, a pre-retirement planning leave, or a leave during which the individual is receiving LTD Benefits.
