If in the sole discretion of the Mayor, or the Acting Mayor in his absence, as defined by City Charter, it is determined that extreme civil emergency conditions exist, including but not limited to, riots, civil disorders, tornado conditions, floods, or other similar catastrophes, the provisions of this Agreement may be suspended by the Mayor, or the Acting Mayor in his absence, during the time of the declared emergency, provided that wage rates and monetary fringe benefits shall not be suspended.
To take any and all actions as may be necessary to carry out the mission of the City and the Police Department in situations of civil emergency as may be declared by the Mayor of the City, or the Acting Mayor in his absence, provided that no right enumerated herein shall be exercised or enforced in a manner contrary to or inconsistent with the provisions of this Agreement.
The Mayor, or the Acting Mayor in his absence, shall follow up said advice in writing as soon thereafter as practicable and shall forward said written notice to the Union Director.
