Notwithstanding anything to the contrary contained herein, each ACO will retain ownership and oversight of each Segregated Account and retain all rights, title, and interest in its Revenue that does not qualify as CMS Proceeds.
Each ACO and its Participating Providers shall retain sole and independent responsibility for all aspects of patient care, including decisions related to the diagnosis, treatment, and referral of patients, consistent with applicable law and standards of practice.
