Accident Pay definition

Accident Pay means a weekly payment of an amount being the difference between the weekly amount of compensation paid to the employee pursuant to the said Workers' Compensation and Assistance Act and the employee's appropriate thirty eight hour award rate, or/and accrued entitlements prescribed by Clauses 13(1) and 18(4) where the incapacity is for a lesser period than one week, the difference between the amount of compensation and the said award rate for that period.
Accident Pay means a weekly amount equal to the difference between workers' compensation payments and the staff member’s normal rate of pay.
Accident Pay means a weekly payment of an amount representing the difference between the amount of compensation to which the employee would be entitled to under the WorkersCompensation Act, 1987, as amended and the employee’s ordinary rate of pay.

Examples of Accident Pay in a sentence

An employee shall not be entitled to the payment of Accident Pay in addition to payment for any period of Annual Leave, Sick Leave, Long Service Leave or any Award Holiday, or for any period for which the employee has received a verdict for damages or a payment as settlement for a claim related to a compensation injury.

Accident Pay is not payable for the first twenty six [26] weeks of a period of incapacity.

An irrevocable authority addressed to any third party requiring such third party out of any verdict which may be obtained by the employee against that third party or any amount of money payable to the employee in settlement of any claim for damages made against that third party to pay to Country Energy the amount of Accident Pay which Country Energy has paid to the employee.

An undertaking that where the injury was caused under the circumstances creating a liability in a third party to pay damages and the employee obtains a verdict for damages or is paid an amount of money in settlement of any claims for damages against that third party the employee will out of such verdict or amount of money repay to Country Energy the amount of Accident Pay which Country Energy has paid.

Accident Pay shall be payable only for a period or periods of incapacity while the employee remains an employee of Country Energy.
