The Servicer shall exercise and enforce the rights of the Trust Fund with respect to the Cash Collateral Accounts under the Mortgage Loan Agreement in accordance with Accepted Servicing Practices and the other terms of this Agreement and the other Whole Loan Documents.
In connection with any foreclosure, enforcement of the Whole Loan Documents or other realization on the Collateral, the Special Servicer shall direct the Servicer to, and the Servicer shall, pay the costs and expenses in any such proceedings as a Property Protection Advance unless the Servicer determines, in accordance with Accepted Servicing Practices, that such Advance would constitute a Nonrecoverable Advance.

Appraisals that are permitted to be requested by any Appraised-Out Class shall be in addition to any Appraisals that the Special Servicer may otherwise be required to obtain in accordance with Accepted Servicing Practices upon the occurrence of such material change or that the Special Servicer is otherwise required or permitted to order under this Agreement without regard to any Appraisal requests made by any Requesting Holder.
