Offers. 2.1 The description of the composition of our goods shall exclusively and conclusively be defined in the respective technical specification (“Technical Specification”). 2.2 We reserve all ownership and intellectual property rights in the illustrations, drawings, plans and construction or engineering documents, etc. ("Documents") relating to the offer. 2.3 Our offers are binding and firm for 45 calendar days from the date of the offer.
Offers. All offers are subject to change. Incoming orders shall only be binding after written confirmation of the order is given by ACAT.
Offers. Our offers are not binding. The contract does not become conclusive until after written confirmation or execution of the order.
Offers. 1.1 All offers and agreements are subject to these Terms of Sale, Delivery and Payment. Please take note of the special terms and conditions applying to installation work. 1.2 Offers are subject to change. Unless agreed otherwise, any specific written offer on the part of the manufacturer shall constitute a binding offer for the duration of 2 months, after which such tender shall be subject to change. 1.3 Obvious errors in the offer may be rectified before acceptance of the offer.
Offers. 2.1. Our offers can be changed or revoked by us at any time until acceptance by the purchaser, unless an offer validity period is expressly stated in the offer. 2.2. The documents belonging to our offers – such as drawings, illustrations, samples and models, information on dimensions, weight, performance and consumption – are only approximate and shall not be deemed to be a specially agreed quality, unless otherwise spe- cified. We reserve the right to make design-related changes. 2.3. Cost estimates, drawings and other documents remain our property and copyright; the purchaser must ensure that these are neither disclosed to third parties nor used for the purposes of third parties.
Offers. Our offers are based on the information provided to us. Offers are made to the best of our knowledge and belief. They are subject to confirmation and are not binding. They are made with the proviso of possible error or prior sale/prior letting.
Offers. 2.1 All SANDOZ offers and price-lists are non-binding unless expressly stated otherwise. 2.2 SANDOZ shall be legally bound by its written offers (including those made per e-mail and telefax) if accepted by CUSTOMER in writing (including e-mail and telefax) for a period of 10 working days. 2.3 Offers of SANDOZ are conditional upon correct and timely deliveries of suppliers of SANDOZ. 2.4 All documents and information submitted by SANDOZ shall be used exclusively for the purpose of the respective transaction, shall in any event be treated by CUSTOMER as confidential information and shall be returned after completion of the transaction immediately upon demand of SANDOZ. Copies, if any, shall be deleted immediately and irretrievably.
Offers. 2.1. Offers from b2 are nonbinding. 2.2. Without the consent of b2, no offer or project documents are to be reproduced or made accessible to third parties. Their return can be demanded at any time, and they shall be returned to b2 immediately if the order is granted to another party. 2.3. Unless otherwise agreed in individual cases, cost estimates are made without guarantee and are liable to cost.
Offers. A quotation shall only be binding if it forms part of an offer and is designated as being binding.
Offers. (1) Unless otherwise agreed in writing, offers and cost estimates from KVH are subject to confirmation. (2) Documents, information, illustrations, drawings, weights, dimensions and performance data forming part of the quotation are only approximate unless they have been expressly designated in writing as binding. The customer's knowledge of the technical, chemical and physical properties of the plastics offered, processed and/or supplied is assumed. If such knowledge does not exist, the customer is obliged to consult KVH; claims arising from lack of or incomplete knowledge are otherwise excluded. KVH manufactures all products exclusively in accordance with KVH's "General Manufacturing Guidelines for Plastic Products in the Vacuum Forming Process" (as at January 2019), unless expressly agreed otherwise in writing. (3) Soweit nicht anders schriftlich vereinbart, bleiben alle Angebotsunterlagen (insbesondere Entwürfe und Zeichnungen der KVH) Eigentum der KVH und dürfen Dritten nicht zugänglich gemacht werden; sie sind auf Verlangen der KVH oder bei nicht Zustandekommen eines Vertrages innerhalb von 14 Tagen zurückzugeben. Erfolgt keine fristgerechte Rückgabe der Unterlagen ist KVH unter Aufrechthaltung der weiteren Ansprüche berechtigt, ohne weitere Fristsetzung den dadurch entstehenden Schaden aufgrund Verzuges geltend zu machen. (4) Für den Fall, dass die Angebotsunterlagen vertragswidrig Dritten überlassen oder zur eigenen Fertigung benützt werden, ist der Kunde pro Fall verpflichtet, an KVH eine Vertragsstrafe in Höhe von 10% des im Angebot enthaltenen Verkaufspreises zu zahlen. Steht ein solcher VK-Preis noch nicht fest, ist für die Errechnung der Vertragsstrafe der übliche VK-Preis zugrunde zu legen. Die Vertragsstrafe fällt auch für den Fall an, dass zwischen KVH und dem Kunden ein Vertrag über die angebotenen Leistungen nicht zustande kommt. Die Geltendmachung eines weiteren Schadens bleibt davon unberührt. Die Vertragsstrafe ist mit der Überlassung der Angebotsunterlagen an Dritte und/oder mit der Nutzung zur eigenen Fertigung fällig.
