Yield Maintenance Agreements. The transactions evidenced by the each Novation Agreement, together with the related Confirmation, each dated as of January 26, 2005, and any other related documents thereto, between BSFP and the Trustee, which shall be an asset of the Trust.
Yield Maintenance Agreements. The Trust shall have the power and authority, and the Trustee (not in its individual capacity, but solely as Trustee hereunder) is hereby authorized and directed, to (i) enter into and perform the obligations of the Trust under each Yield Maintenance Agreement and (ii) exercise and enforce the rights of the Trust as specified therein.

Yield Maintenance Agreements. (A) On the Closing Date, Trustee shall, for the benefit of the RALI Series 2006-QH1 Trust, enter in the Class A/Class M Yield Maintenance Agreement with the Yield Maintenance Agreements Provider. On the Business Day prior to each Distribution Date from and including the Distribution Date in January 2007 to and including the Distribution Date in October 2011, the Trustee shall deposit any amounts received under the Class A/Class M Yield Maintenance Agreements into the Certificate Account. On each Distribution Date from and including the Distribution Date in January 2007 to and including the Distribution Date in October 2011, the Trustee shall withdraw from the Certificate Account any amounts received under the Class A/Class M Yield Maintenance Agreement and distribute such amounts as follows: (i) first, to the Holders of the Offered Certificates in the order of priority set forth in Section 4.02(c)(i), to cover Accrued Certificate Interest (after taking into account the distributions made pursuant to Section 4.02(c)(i) on that Distribution Date); (ii) second, to the Holders of the Offered Certificates in the order of priority set forth in Section 4.02(d), to cover Realized Losses to extent necessary to maintain the Required Overcollateralization Amount; (iii) third, to the Holders of the Offered Certificates in the order of priority set forth in Sections 4.02(c)(vi) and (vii), to cover Interest Carryforward Amounts and Basis Risk Shortfalls (after taking into account the distributions made pursuant to Sections 4.02(c)(vi) and (vii) on that Distribution Date); and (iv) fourth, to the Holders of the Class SB Certificates.
Yield Maintenance Agreements. The Depositor hereby authorizes and directs the Trustee to (i) enter into and perform the obligations of the Trustee, not in its individual capacity but solely as Trustee of the BellaVista Mortgage Trust 2005-2, under the Yield Maintenance Agreements and (ii) exercise and enforce the rights of the Trustee as specified therein.
Yield Maintenance Agreements. The Class 1-A1 Yield Maintenance Agreement and the Class 1-A8 Yield Maintenance Agreement, as described in Section 5.29 and set forth in Exhibit U and Exhibit U-1 hereto, respectively. Yield Maintenance Agreements. The Yield Maintenance Agreements, dated July 29, 2005 between the Trust (on behalf of the Class I-A-1 Certificateholders and Class I-A-2 Certificateholders) and Bear Xxxxxxx Financial Products Inc.
Yield Maintenance Agreements. (a) In the event that the Indenture Trustee or the Paying Agent does not receive any required payment from the Yield Maintenance Provider under either the Group I Yield Maintenance Agreement or the Group II Yield Maintenance Agreement, as applicable, the Indenture Trustee, upon the written direction of any of the Enhancer, a majority of the Noteholders or the Servicer shall enforce the obligation of the Yield Maintenance Provider thereunder. The parties hereto acknowledge that the Yield Maintenance Provider shall make all calculations, and determine the amounts to be paid, under the Yield Maintenance Agreements. Absent manifest error, the Indenture Trustee and the Paying Agent, as applicable, may conclusively rely on such calculations and determinations.
Yield Maintenance Agreements. (a) On or prior to the Closing Date, the Trustee, on behalf of the Trust, will enter into the Yield Maintenance Agreements for the benefit of the Holders of the LIBOR Certificates. The Yield Maintenance Agreements will be assets of the Trust Fund but will not be assets of any REMIC created hereunder. The Trustee shall deposit any amounts received with respect to the Yield Maintenance Agreements into the related Carryover Reserve Fund Account.
