WORK ON PREMISES Sample Clauses

WORK ON PREMISES. If Seller’s work under this order involves operation by Seller on the premises of Buyer or one of Buyer’s customers, Seller shall take all necessary precautions to prevent injury to any person or property during the progress of such work. Seller shall indemnify Buyer against all loss arising from such work, which may result in any way from any act or omission of Seller, its agents, employees, or subcontractors unless such is caused by willful misconduct or gross negligence on the part of Buyer. Seller shall maintain such public liability, property damage and employee’s liability and compensation insurance as will protect Buyer from said risk and from any claims under applicable worker’s compensation and occupational disease act.

WORK ON PREMISES. If the PO includes the performance of services or delivery or installation of Products by Vendor, and involves operations by Vendor’s employees or subcontractors on PetSmart’s premises or the premises of a PetSmart customer, Vendor will: (i) at all times enforce strict discipline and maintain good order among all persons engaged in the activity on such premises and will cause Vendor’s employees and subcontractors to comply with all fire prevention and safety rules and regulations in force at the premises and required by law; (ii) keep such premises free from accumulation of waste materials and rubbish caused by its employees or subcontractors and upon completion promptly remove all of Vendor's equipment and surplus materials; and (iii) reimburse PetSmart for all reasonable costs and expenses incurred by PetSmart for repairs completed by PetSmart or its designee if Vendor damages any equipment or property of PetSmart or its customer, or causes any damage to any portion of PetSmart’s or its customers’ premises, either during or resulting from the delivery or performance of the Products by Vendor. Under no circumstances will Vendor conduct or permit any hazardous activity or handling any hazardous materials at PetSmart’s or its customers’ premises without first coordinating the details of such activity or handling with PetSmart.
WORK ON PREMISES. If this Order involves the presence of Seller on the premises of the Buyer or Buyer's Customer, Seller shall comply with all safety and security regulations and shall take all necessary precautions to prevent injury or damage to persons or property while so engaged. Seller shall indemnify, defend, and save Buyer and/or Buyer's Customer harmless from and against all liability, losses and expenses (including costs and attorney's fees) for any suit, claim, settlement, award or judgment ( herein referred to singly or collectively as the "claim") arising out of the failure of Seller to comply with safety and security regulations, and out of any negligence on the part of Seller, except to the extent such claim may be caused solely by the negligent act or omission of Buyer and/or Buyer's Customer.
WORK ON PREMISES. If labor is to be furnished at the premises of Buyer or Buyer’s customer, Seller shall, before starting work, furnish Buyer with certificates of insurance providing evidence of the following insurance coverage: Workmen’s Compensation insurance with limits and provisions as provided by statute with minimum employer liability limits of $500,000; general liability and products liability insurance with minimum limits of $1,000,000 for each occurrence and $1,000,000 aggregate; and automobile insurance of owned and non-owned vehicles with limits of at least $1,000,000. The existence of such insurance, however, shall not relieve Seller of its obligations under Section 9 hereof.
WORK ON PREMISES. If Seller’s performance of services or delivery or installation of goods involves activities by its employees or subcontractors on Buyer’s premises or the premises of a customer of Buyer, then (1) Seller shall at all times enforce strict discipline and maintain good order among all persons who engage in the activity on the premises and shall cause them to comply with all fire prevention and safety rules and regulations that are in force at the premises and (2) Seller shall keep the premises free from accumulation of waste materials and rubbish that its employees or subcontractors cause and upon completion shall promptly remove all of Seller's equipment and surplus materials, (3) Seller shall remove from the premises all waste, including chemical compounds, that are generated at or brought to the premises, (4) Seller shall not use any chemicals or compounds that contain ozone-depleting compounds, carcinogens or silicon, (5) Seller shall not dispose of any liquid waste on Buyer’s premises or discharge any material to a sanitary or storm sewer without permission from Buyer’s Corporate Environmental Engineer, (6) before beginning work, Seller shall provide to Buyer’s project leader Material Safety Data Sheets for all materials that are used on the premises, and (7) Seller shall immediately notify Buyer’s project manager of any spill or environmental accident of any kind and provide a written report of the incident to the plant Environmental Contact within 24 hours after the occurrence.
WORK ON PREMISES. 10.1 Workers who work on the premises of the Company or a customer of the Company will comply with all applicable site rules and regulations, and the Contractor will take all necessary precautions to prevent injury to persons or property during the performance of Services and work under this Amendment. The Contractor specifically and expressly agrees to defend, indemnify and hold harmless and reimburse, at its own expense, the Company, its directors, officers, employees, [[[***]]] CONFIDENTIAL TREATMENT REQUESTED. CONFIDENTIAL PORTIONS HAVE BEEN REDACTED AND FILED SEPARATELY WITH THE COMMISSION. Confidential Information of GE and Genpact agents, representatives, successors and assigns (each an “Indemnified Party”) against any and all loss, damage, suits, liability, claims, demands, costs, judgments, fines, penalties, expenses, and attorneys’ fees and disbursements (“Liabilities”) resulting from injury or harm to persons or property, including claims of the Contractor’s own Workers, arising out of or in any way related to the Contractor’s performance under this Amendment, and the Contractor shall indemnify, hold harmless, and reimburse the Company with respect to such Liabilities as such Liabilities are incurred. The Contractor’s activities shall be deemed to include those of its Workers, officers, agents and Subcontractors. In claims made by a Workers of the Contractor or a Subcontractor (or anyone directly or indirectly employed by Contractor or Subcontractor or for whose acts Contractor or Subcontractor may be liable) against any Indemnified Party under this section, the Contractor’s indemnification obligation shall not be limited by a limitation on amount or type of damages, compensation, or benefits payable by or for the Contractor or a Subcontractor under workers’ or workmen’s compensation acts, disability benefits acts, or other employee benefit acts. The purchase of insurance by the Contractor with respect to its performance hereunder shall in no event be construed as fulfillment or discharge of its indemnification obligations under this Amendment. None of the foregoing provisions shall deprive the Company of any action, right, or remedy otherwise available to it at law or in equity. Limitation on Liability
WORK ON PREMISES. If Seller’s performance under this Purchase Order involves operations by Seller on the premises of Buyer or one of its Customers, Seller shall comply with all applicable provisions of Federal, State, Provincial and local laws and regulations including rules, safety requirements and regulations established for such work site. Seller shall take all necessary precautions to prevent the occurrence of any injury to persons or property during the progress of such performance. Seller shall indemnify Buyer and its Customers against all loss which may result from any act or omission of Seller, its agents, employees, or subcontractors.

WORK ON PREMISES. (a)If Supplier’s employees, contractors, or agents provide services to Buyer on Buyer’s premises or Buyer’s customer’s premises, Supplier shall examine the premises to determine whether they are safe for such services and shall advise Buyer promptly, in writing, of any situation it deems to be unsafe. Supplier shall handle and be responsible for every claim that arises from Supplier’s work on Buyer’s premises or Buyer’s customer’s premises that is for actual or alleged injury or damage to any person, property, economic loss, worker’s compensation claim, or violation of any law. Or at Buyer’s option provide at reasonable assistance to Buyer in Buyer’s handling of such claims, unless the claim arises from the negligence or recklessness of Buyer, its agents, or employees.
WORK ON PREMISES. If Supplier’s performance of services or delivery or installation of Products involves operations by its employees or subcontractors on Purchaser’s premises or the premises of a customer of Purchaser, then (a) Supplier shall at all times enforce strict discipline and maintain good order among all persons engaged in the activity on the premises and shall cause them to comply with all fire prevention, health, environmental and safety rules and regulations in force at the premises, (b) Supplier shall comply with any special work conditions that are attached to the Order, and (c) Supplier’s performance of the services shall not interfere with Purchaser’s use of the premises or pose any danger to Purchaser’s employees or invitees.
