Where the Secretary of State declares a ballot void he shall notify the persons mentioned in paragraph 44 of that fact.

(delegate) believes there is insufficient productive work available for the excess employee during the retention period, the Secretary (delegate) may, with the agreement of the excess employee, terminate the employee’s employment under section 29 of the PS Act during the retention period on the grounds that they are excess to requirements and pay the balance of the retention period as a lump sum amount. The lump sum payment will be taken to include payment in lieu of notice of termination.
Where the Secretary of State intends to continue with projects equivalent to any or all of the Work after termination or expiry of the Agreement, either by performing such projects itself or by the appointment of a replacement contractor, the Contractor shall use all commercially reasonable endeavours to ensure that any transition to the replacement contractor is undertaken with the minimum of disruption to the Secretary of State.
