The Warranty Performance clause defines the obligations of a party, typically the seller or service provider, to ensure that the goods or services supplied meet specified standards or perform as promised. This clause usually outlines the duration of the warranty, the process for making claims, and the remedies available if the product or service fails to perform as warranted, such as repair, replacement, or refund. Its core function is to protect the buyer by holding the provider accountable for the quality and reliability of their offering, thereby reducing the risk of defective or substandard performance.
WARRANTY PERFORMANCE. JETBLUE AIRWAYS shall make its warranty claim enclosing a detailed written report of the defects observed, giving the reasons, the conditions and circumstances of the defects. The above details shall be forwarded to EAS, immediately and within a maximum of three (3) weeks of discovering the defects. For Equipment/Components under warranty, the defective item will be delivered by JETBLUE AIRWAYS, for repair or Standard Exchange hereafter. With prior EAS approval, freight costs shall be the responsibility of EAS. EAS shall proceed in its workshops to the corrective actions at its own costs. For Aircraft under warranty, in case of AOG, EAS will send one or more specialist(s) to proceed to the repair work. Should the warranty claim be rejected, the repair Maintenance Services including shipping costs and specialists assignment (if applicable) will be invoiced to JETBLUE AIRWAYS on a time-and-material basis in accordance with terms and conditions of Article XI "Financial Conditions".
WARRANTY PERFORMANCE. Provider represents and warrants that: (a) Subscription Services provided under any SaaS Subscription Schedule and Non-subscription Services provide under a Statement of Work shall be provided and performed by qualified personnel in a professional, workmanlike manner, consistent with the prevailing standards of the industry; (b) it shall use industry best practices to fulfill its obligations under each SaaS Subscription Schedule and Statement of Work; and (c) any deliverables provided by Provider shall operate in conformance with the terms of this Master Software as a Service Agreement and the applicable SaaS Subscription Schedules and Statements of Work.
WARRANTY PERFORMANCE. Vendor warrants that the products and services furnished pursuant to this Purchase Order shall: (a) comply with all federal, state and local laws applicable thereto; (b) satisfy all requirements set forth on the face of this purchase order and any applicable documentation incorporated herein; (c) meet industry standards and be suitable for the purpose intended; (d) be of merchantable quality; and (e) be free from defects in title, labor, material or fabrication.
WARRANTY PERFORMANCE. Where Seller is under liability for warranty under this Section 7, then Seller will at its own cost (including costs of packing, installation, shipping and insurance): 7.2.1 Make good any shortage or non-delivery; and 7.2.2 Maintain sufficient stock quantities of Goods to ensure replacement/shipment of warranty items within 48 hours of notice by AmSafe; 7.2.3 at AmSafe’s option, (a) provide a refund to AmSafe with respect to the subject Goods, (b) within five (5) days of demand therefore by AmSafe, deliver to the location indicated by AmSafe such replacement Goods as are necessary for the correction of the subject defect, or (c) promptly repair the affected Goods. Any remedial action under this Section 7.2 shall be without prejudice to AmSafe’s other rights under these Terms and Conditions. In the event of warranty repair or replacement, Seller will provide a warranty period for the repaired or replaced Goods equal to the period initially provided.
WARRANTY PERFORMANCE. Miraloma Manufacturing (at its sole discretion) or an Independent Authorized Service Representative will repair or replace any component found defective under the terms of this warranty. Parts and labor are covered by Miraloma Manufacturing. A reasonable service call trip fee may be assessed by the authorized service provider.
WARRANTY PERFORMANCE. In the event of a manufacturing defect within the terms and conditions set forth herein, Cabinetworks Group will repair or replace the product, at Cabinetworks Group’s sole option, without charge. Such repair or replacement is contingent upon the current product offerings within the Cabinetworks Group product line at the time of the warranty claim. If the affected product is no longer available, Cabinetworks Group reserves the right to (i) replace the affected component with a new component of the same style, or (ii) replace the affected component and any other component within the total product to achieve a uniform appearance with a similar and comparable product style and quality as the original product. Due to changes that occur during the wood’s natural aging process, Cabinetworks Group cannot guarantee that replacements will exactly match the finish and appearance of the remaining components in the original product. Cabinetworks Group will not provide or pay for the cost of (i) removal of defective product, (ii) transportation of defective, repaired, or replaced product, or (iii) installation of repaired or replaced product. Repaired or replaced product shall be warranted for a period equal to the remainder of the original Limited Warranty on the original product or for ninety days, whichever is longer. disputes with Cabinetworks Group arising in any way from this Limited Warranty or the sale, condition or performance of the Products shall be resolved exclusively through final and binding arbitration, and not by a court or jury.
WARRANTY PERFORMANCE. If a defect does occur within the terms and conditions of this warranty, such defective part will be repaired or replaced by Fresh Floor Kitchen & Bath at its sole discretion. Fresh Floor Kitchen & Bath will not provide or pay for the cost of removal of defective product, transportation of defective, repaired or replaced product or installation of repaired or replaced product. Fresh Floor Kitchen & Bath will not be responsible for any shipping damages to the defective, replaced or repaired product. WARRANTY PERFORMANCE. For the period during which the -------------------- existing warranty obligations of Seller are in effect, if any customer of Seller is entitled, pursuant to such obligations to, and does, seek warranty work on any item sold by Seller prior to Closing, Buyer shall have the right (but not the obligation) to provide such warranty work on such item for Seller's account. Seller, when provided with a bona fide warranty document, shall pay Buyer for such work based on the following criteria: (a) Labor shall be reimbursed at the rate of 125% of the Buyer's cost for burdened labor. The cost of burdened labor for fiscal 1997 will be $25.00 per hour.
WARRANTY PERFORMANCE. The Supplier undertakes to meet certain performance levels in its implementation of the warranty service: HELPDESK RESPONSE Answers to RMA requests made by telephone or email or fax to a helpdesk will be fulfilled within the next 2 (two) working days. REPAIR TURNROUND Turnaround time on all Materials returned for repair under the terms of this warranty will not exceed 7 (seven) working days from receipt of the faulty unit at location specified in table above.
WARRANTY PERFORMANCE. In the event of a defect covered under the terms of this Limited Warranty, notify your authorized Legacy Whirlpools dealer. A Legacy Whirlpools authorized service technician will repair the spa subject to the Terms and Conditions of this Limited Warranty. Use all reasonable means to protect the spa from further damage. Reasonable travel charges may be assessed by Legacy Whirlpools or its authorized service technician if the spa is located outside the nearest authorized service technician’s service area.
