Waiver of Participation. During open enrollment or within 30 days of a qualifying event (as defined by the County of Marin Section 125 Plan), any employee covered by this Agreement may make written application to the Human Resources Director for waiver of required participation in a County medical plan if said employee provides acceptable proof of equivalent coverage in a group plan through other sources. An employee who waives participation under this section shall use the fringe-benefit package to pay for mandated benefits and may receive up to one hundred dollars ($100.00) cash back of any remaining unused amount of their biweekly fringe benefit package. Otherwise, effective December 16, 2007, there will be no additional cash back provided.

Waiver of Participation. 1. Exhibitor's waiver of participation in the Fair, in any form whatsoever, following Organizer's acknowledgment of receipt of the Notification for processing, shall be ineffective and shall not release Exhibitor from the obligation to make its performance(s). Exhibitor shall be under the aforesaid obligation notwithstanding its actual non- attendance at the Fair. In neither of the foregoing cases shall Organizer be obligated to reimburse any amounts paid by Exhibitor or on behalf thereof with regard to its notification of participation in the Fair. In the event of Exhibitor's non-attendance at the Fair, Organizer shall be empowered to impose on the former a stipulated penalty of 50% of the total amount according to the Notification per day of non-attendance.
Waiver of Participation. Effective with the initial adoption or upon the amendment or restatement of this Plan, otherwise eligible Employees may not execute a waiver of participation. Any properly executed waivers of participation executed prior to the adoption of the Plan shall be grandfathered and such waiver shall be valid in full force and effect. Waivers of Plan participation must not constitute cash or deferred arrangements [within the meaning of Code Section 401(k)] or they shall be ineffective. A waiver shall not be considered a cash or deferred arrangement if it is irrevocable, applies to all Plans maintained by the Employer, and is made prior to the date on which the Employee is first eligible to participate in the Plan of the Employer. The Plan Administrator shall establish uniform and nondiscriminatory procedures as it deems necessary to carry out this provision including, but not limited to, rules prescribing the timing and filing of elections not to participate. The Plan Administrator shall determine the propriety of any such waiver. An Employee or Participant continues to earn credit for each Year of Service for eligibility or vesting purposes he or she completes and his or her account (if any) will share in the gains or losses of the Plan during the periods he or she elects not to participate.

An employee who waives participation under this section shall use the fringe benefit package to pay for mandated benefits and may receive up to one hundred dollars ($100) cash back per pay period. Otherwise, effective upon ratification and approval of this agreement, no additional cash back will be provided.
Waiver of Participation. A Participant may in the Participant’s sole and absolute discretion waive his or her right under the Plan at any time. Any waiver permitted under this section 8.3 shall be in writing and delivered to the Board of Directors of the Company.

Waiver of Participation. Any employee covered by this Agreement may make written application to the Executive Director for waiver of required participation in a health insurance program if said employee provides acceptable proof of Affordable Care Act compliant coverage through other sources. This means that the employee must show proof of alternative minimum essential medical coverage for the employee and the employee’s taxable family (individuals for whom the employee expects to claim a personal exemption deduction). Individual coverage and individual coverage from Covered California does not qualify as alternative minimum essential coverage under this section.
Waiver of Participation. In addition to the provisions of this section, employees who elect to waive participation in the City's health insurance program or private health insurance plan, upon written request to waive said participation and proof of alternative health insurance coverage, shall receive from the City the equivalent of fifty percent (50%) of the City's contribution towards unit employee's health insurance plan.

If this is an amendment and restatement of this Plan, then all prior irrevocable waivers will remain in effect after the adoption date of this amendment and restatement. If a prior Plan document permitted revocable waivers of participation, then any Eligible Employee who had previously waived participation on a revocable basis may revoke such waiver and participate in the Plan; however, such Eligible Employee may not waive participation again on or after the adoption date of this amendment and restatement.
