Waive Statutes. Lessor and Lessee agree that the terms of this Lease shall govern the effect of any damage to or destruction of the Premises with respect to the termination of this Lease and hereby waive the provisions of any present or future statute to the extent inconsistent herewith.

Lessor and Lessee agree that Paragraph 3.3, above shall apply to any damage to or destruction of the Premises occurring prior to the Commencement Date.
Waive Statutes. Notwithstanding any present or future statute to the contrary (including, without limitation, Cal. Civ. Code Section 1932, 1941 and 1942), Lessor and Lessee agree that the terms of this Lease shall govern the effect of any damage to or destruction of the Premises with respect to Lessor's obligations to make repairs or to terminate this Lease.
