Used Equipment. When this ITB authorizes offers of used items, no used item is acceptable if serial numbers or any other manufacturer's identifying label or markings have been removed, obliterated, or changed in any way.
Used Equipment. If the proposed Transaction supports any purchase of used equipment, a Request for Ex-Im Bank Approval of Used Equipment accompanied by a Used Equipment Questionnaire has been previously submitted to Ex-Im Bank.
Used Equipment. NOTWITHSTANDING ANYTHING TO THE CONTRARY HEREIN, USED EQUIPMENT IS SOLD IN AN AS IS, WHERE IS CONDITION. SELLER MAKES NO REPRESENTTIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE NATURE, QUALITY OR CONDITION OF THE EQUIPMENT, OR ITS SUITABILITY FOR ANY USE, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, UNLESS EXPRESSLY AGREED UPON IN WRITING BETWEEN THE PARTIES. SELLER SHALL HAVE NO LIABILITY TO BUYER HEREUNDER OR IN CONNECTION WITH THE EQUIPMENT, INCLUDING WITHOUT LIMITATION, FOR LOSS OF PROFIT, LOSS OF INCOME, LOSS OF PRODUCTION, LOSS OF OPPORTUNITY, INDIRECT, CONSEQUENTIAL, INCIDENTAL, PUNITIVE OR EXEMPLARY DAMAGES.
Used Equipment. Lessee acknowledges that the Equipment may be used gear and may be cosmetically flawed. However, Lessor warrants that the Equipment, whether new or used, will be in proper working condition when leased to Lessee. Should Lessee discover that the Equipment, as received, is not working properly, Lessee agrees to notify Lessor pursuant to Section 15 of this Agreement.
Used Equipment. Lessor will purchase "used" Equipment which is obtained from a third party by Lessee for its use subject to: (1) Lessor's prior approval of the Equipment; and (2) at Lessor's appraised value for such used Equipment.
Used Equipment. I-Dealer and its Personnel shall only sell to Subscribers used Equipment originally supplied to I-Dealer and/or otherwise approved by Company. Unless otherwise
Used Equipment. It is likely that the equipment rented to Customer will have been previously used by other customers in uses over which AquaVISION has no control. All equipment has been cleaned prior to delivery to Customer. AquaVISION’s cleaning procedures will be provided to Customer upon request. AquaVISION cannot guarantee that the equipment is free from contamination caused by previous uses not disclosed to AquaVISION. If any AquaVISION equipment is determined to be unsuitable, Customer's sole remedy shall be that provided in Paragraph 8 herein.
Used Equipment. The warranty referred to in clause 8.1 does not apply to Used Equipment. Warranty terms applicable to Used Equipment are set out in Item 2 of Annexure A. For avoidance of doubt, the warranty for Used Equipment stated in Item 2 of Annexure A is BTP’s sole liability for the Buyer’s purchase, use or re-sale of Used Equipment and the Buyer indemnifies and keeps BTP harmless from any claim, loss, damage or expense arising from or connected to the Buyer’s purchase, use or re-sale of Used Equipment.
Used Equipment duration identified in the Quotation, but in no event more than 1 year. If no warranty is identified, the Used Equipment is not warranted by GE Healthcare.
Used Equipment. Lessor warrants to the Lessee that Used Modular Equipment module(s) have been serviced using sound materials and parts, and that the Modular Equipment will be serviceable for a period of sixty (60) from the date of commencement of the Lease Term, provided Lessee notifies Lessor in writing of any defects, malfunctions, or leaks within two (2) business days of occurrence thereof. In addition and subject to Section 17(d) herein, Used Value Added Product including, but not limited to, major appliance (such as HVAC, water heaters, etc.) where the manufacturer’s invoice cost exceeds Five Hundred Dollars ($500.00) will be warranted for term of lease to a maximum one (1) year from the date of commencement of the Lease.
