Use of the Word. “Including” The word “including”, when following any general statement or term, is not to be construed as limiting the general statement or term to the specific items or matters set forth or to similar items or matters, but rather as permitting the general statement or term to refer to all other items or matters that could reasonably fall within its broadest possible scope.
Use of the Word. Gabelli" It is understood and agreed that the word "Gabelli" is the Adviser's property for copyright and other purposes. The Fund further agrees that the word "Gabelli" in its name is derived from the name of Xxxxx X. Xxxxxxx and such name may freely be used by the Adviser for other investment companies, entities or products. The Fund further agrees that, in the event that the Adviser shall cease to act as an investment adviser to the Fund, the Fund shall promptly take all necessary and appropriate action to change its name to one that does not include the word "Gabelli"; provided, however, that the Fund may continue to use such name if the Adviser consents in writing to such use.
Use of the Word. Fidelity". Fidelity Management & Research Company ("FMR") has consented to, and granted a non-exclusive license for, the use by any Series or by the Company of the identifying word "Fidelity" or "Spartan" in the name of any Series or of the Company. Such consent is subject to revocation by FMR in its discretion, if FMR or subsidiary or affiliate thereof is not employed as the investment adviser of each Series of the Company. As between the Company and FMR, FMR controls the use of the name of the Company insofar as such name contains the identifying word "Fidelity" or "Spartan." FMR may, from time to time, use the identifying word "Fidelity" or "Spartan" in other connections and for other purposes, including, without limitation, in the names of other investment companies, corporations or businesses which it may manage, advise, sponsor or own or in which it may have a financial interest. FMR may require the Company or any Series thereof to cease using the identifying word "Fidelity" or "Spartan" in the name of the Company or any Series thereof if the Company or any Series thereof ceases to employ FMR or a subsidiary or affiliate thereof as investment adviser.

Use of the Word. “FREE” The word "free" may be used in relation to the demo mode, the software, the platform, and the charts. The word"free" shall not be used concerning trade or risk. Practical examples of the restrictions on the use of the word ‘free’ are asfollows: “Say”: • "The demo mode is free of risk" • "Free download of the platform" • "Free software to use for trading with Freedom Finance Europe Ltd." • "Free live streaming charts and quotes in Freedom Finance Europe Ltd. " Do not say: •"Risk-free trading" •"All in one package for free trading with Freedom Finance Europe Ltd."
Use of the Word. HEREIN". The words "herein," "hereof," "hereinafter," "hereunder" and other words of similar import refer to this Mortgage as a whole and not to any particular Article, Section, subsection or other subdivision of this Mortgage unless specifically noted otherwise in this Mortgage.
