The Use Limits clause defines the boundaries and restrictions on how a product, service, or information may be used by the recipient. Typically, it specifies permitted and prohibited uses, such as restricting use to internal business purposes or forbidding redistribution to third parties. Use Limits. Client is prohibited from performing any load testing against IWT’s hosted production environments, without the prior express written permission of IWT. Client is prohibited from reverse engineering, decompiling, and disassembling the Licensed Products.
Use Limits. Customer shall use the System solely for its internal business process as contemplated by this Agreement and shall not: (i) license, sub-license, sell, re-sell, rent lease, transfer, assign, distribute time share or otherwise commercially exploit or make the System available to any third party, other than as contemplated by this Agreement; (ii) intentionally utilize the System to violate the law or rights of any person or entity, including sending spam, unlawful or tortious material; (iii) intentionally send or store software viruses, worms Trojan horses or other harmful computer code, files, scripts, agents or programs; (iv) intentionally interfere with or disrupt the integrity of the System or the data contained therein; or, (v) intentionally attempt to gain unauthorized access to the System or its related systems or networks.
Use Limits. The Records shall not be used in place of a criminal history background check which is available from the State of Minnesota Bureau of Criminal Apprehension.
Use Limits. You will not, and will not permit your Authorized Users to: 1. violate the Acceptable Use Policy or use the Platform Services other than in accordance with the Documentation; 2. copy, modify, disassemble, decompile, reverse engineer, or attempt to view or discover the source code of the Platform Services, in whole or in part, or permit or authorize a third party to do so, except to the extent such activities are expressly permitted by the Agreement or by law notwithstanding this prohibition; 3. sell, resell, license, sublicense, distribute, rent, lease, or otherwise provide access to the Platform Services to any third party except to the extent explicitly authorized in writing by Databricks; 4. use the Platform Services to develop or offer a service made available to any third party that could reasonably be seen to serve as a substitute for such third party’s possible purchase of any Databricks product or service; 5. transfer or assign any of your rights hereunder except as permitted under Section 11.4 (Assignment) of the MCSA; or 6. during any free trial period granted by Databricks, including during the use of any Beta Service, use the Databricks Services for any purpose other than to evaluate whether to purchase the Databricks Services.
Use Limits. Services are subject to a Minimum Quantity Commitment (hereinafter, “MQC”) specified in the applicable Order Form(s). If Customer fails to meet an annual MQC, Customer will be charged at the end of the Term for any shortage of meeting the MQC in accordance with Section 5(b).
Use Limits. Services are not intended for and Customer will not use the Services to store, transmit or process data for any applications or uses that: (i) require or relate to information or technology subject to military or dual use export controls; (ii) might greatly endanger individuals, property or the environment, such as operation of: (A) ships, aircraft, railroads and motor vehicles; (B) chemical or nuclear facilities; (C) critical public infrastructure (such as power stations); and (D) medical devices used in patient care; or (iii) involve implementation or provision of regulated network and/or telecommunications services. Applications or uses that require or relate to compliance with specific regulatory standards that apply to Customer’s data, business and use of Services (such as those for health care and related services, financial services, payment card transactions) are permitted to the extent contemplated by the SOW(s). Customer may use the Services to store information subject to import and export controls under the condition that the Parties agree to comply with all applicable import, re-import, export, and re-export control laws and regulations, including the Export Administration Regulations, the International Traffic in Arms Regulations, and country-specific economic sanctions programs implemented by the Office of Foreign Assets Control.
Use Limits. Only1 reserves the right to establish general practices and limits concerning user accounts at any time (and may modify such practices and limits at its sole discretion), including without limitation the maximum number of days that any information or content will be retained and the maximum amount of file space that will be allotted on our servers on your User Account. You acknowledge that Only1 reserves the right to log off user accounts that are inactive for an extended period of time and reserves the right at any time, and from time to time, to modify or discontinue, either temporarily or permanently, the Site, the Platform, or the Services (or any part thereof) with or without notice. You agree that Only1 shall not be liable to you or to any third party for any such modification, suspension or discontinuance or your User Account.
Use Limits. Use Limits will be as indicated on an Order. If, to the extent applicable, Customer uses Products in an approved ‘air-gapped’ manner (where Apollo cannot calculate Use Limits), Customer agrees to provide Apollo with regular reporting as reasonably requested. For purposes of calculating certain Use Limits referred to as ‘operations,’ Apollo counts unique traffic processed by any Apollo Technology used by or on behalf of Customer or its Affiliates.
Use Limits. Product Offerings may have User or Device quantity limits, which will be set forth in the applicable Quote or Order. If you exceed those use limits, we will work with you to either order additional quantities of the applicable Product Offerings or reduce your use, so it meets the contractual limits. If you are unable or unwilling to stay within the limits, we may suspend access to the Product Offerings until you comply with them.
Use Limits. All HP Hardware, HP Software and HP Services purchased or made available to Delphi under this Agreement or the Related Agreements may only be used on, or in connection with, ▇▇▇▇.▇▇▇. Delphi may not during the Term sell to any third party any HP Hardware purchased or made available to Delphi under this Agreement.
