Usage Reporting. You consent to the Vendor reporting to Red Hat your usage of the Red Hat Software Subscriptions in the Vendor’s Cloud.
Usage Reporting. You shall provide Blue Planet with quarterly usage reports generated by the Software. During the term of this Agreement and for a period of twelve (12) months thereafter, You agree that Blue Planet or its authorized representative has the right, no more than once every twelve (12) months, upon thirty (30) days written notice to You, to inspect Your records, systems and facilities to verify that Use of the licensed Software is in conformity with this Agreement. You agree to give Blue Planet or its licensors and its independent auditors the right to examine Your books, records, systems and Use of the licensed Software during regular business hours upon reasonable notice to verify compliance with this Agreement. If such audit discloses non-compliance with this Agreement, You shall promptly pay to Blue Planet the appropriate license Fees, plus the reasonable costs of conducting such audit.
Usage Reporting. Contractor shall be required to submit usage reports for analysis to the Division of Procurement and Support Services, Purchasing Agent/Contract Manager. Contract Number (State of New Hampshire Contract # and Multi-State Contract Number/Agreement Reference). Utilizing Agency and Eligible Participants Items sold and/or all products purchased (showing the Manufacturer, item, part number, and the final cost) Total cost of all products purchased. Ability to sort as needed from any category, including Agency and/or eligible participant Excel or CSV formatted document or other compatible document ORDERING: State agencies will place their orders direct to vendor or authorized reseller by electronic order entry, by e-mail, by FAX, or they may establish a standard delivery order. Eligible Participants will utilize their own individually established ordering procedures. ORDER INSTRUCTIONS:
Usage Reporting. GT agrees to provide to AXP (in an email test format or AXP can download through online access) usage and tracking reports on a daily, weekly, and monthly basis by Sites and shall be segmented by type of Sites, when available, as specified in the Exhibit "V." Reports will include the specific types of reports identified in Exhibit "V." At all times during the Term, GT shall provide to AXP, at AXP's written request and expense, a recent copy of the AXP User Information in a mutually agreed format.
Usage Reporting. During the term of this Agreement and for a period of twelve (12) months thereafter, VAR agrees that Blue Planet or its authorized representative has the right, no more than once every twelve (12) months, upon thirty (30) days written notice to VAR or the End User to inspect VAR’s or the End User’s records, systems, facilities, and service activities conducted on the Software, to verify that Use of the licensed Software is in conformity with this Agreement. If such audit discloses non-compliance with this Agreement, VAR shall promptly pay to Blue Planet the appropriate license fees, plus the reasonable costs of conducting such audit.
Usage Reporting. A. Contractor shall submit usage reports on a quarterly basis to the State Contract Administrator for all California entity purchases using the report template attached hereto as Attachment A. The report is due even when there is no activity.
Usage Reporting license breaches and legal remedies. SYNAPTICON reserves the right, and Customers hereby authorize SYNAPTICON to collect data on the use of the license, including license numbers, IP addresses of Authorized Devices or other applicable device identifiers (including MAC addresses and/or UDID), domain counts and other relevant information, to ensure that the products are being used in accordance with the terms of this Agreement. SYNAPTICON reserves the right to remedy any breach of the terms of this Agreement immediately after its discovery, by arranging for the means of payment used for the originally authorized purchase to be charged with the in each case up-to-date list price for the license used in an unauthorized manner, or to remedy this by some other necessary means, including the remote disabling of the Software. Customers undertake not to block the transmission of data required for compliance with this Agreement electronically or otherwise. Any blocking of data required for compliance with this Agreement is considered to be a breach of this Agreement and shall lead to the immediate termination of this Agreement pursuant to section 4. Customers agree that they shall pay, in each case, the sum of € 100,000 (Euro one hundred thousand) for every breach of this section, albeit that Customers are entitled to demonstrate and provide evidence of the fact that the actual loss or damage was less than the amount cited and, provided SYNAPTICON is entitled by law to exercise other legal remedies, SYNAPTICON shall continue to reserve such rights.
Usage Reporting. Client’s billing and usage data will be delivered to Relativity through the Software in accordance with the applicable Documentation. Relativity has provided an optional feature in the Software by which Client may choose to obfuscate case names and/or the client or matter names and/or the personal name portion of the email address used for Named User log-ins. If Client uses that obfuscation feature and is licensing more than one Production Instance of the Software, Relativity may require that Client consistently uses the obfuscation feature in all Production Instances in order to handle billing determinations consistently. In such cases, Client shall provide such additional information, upon request, as may be necessary for Relativity’s billing and auditing purposes. Upon Relativity’s requests from time to time, Client shall also cooperate in: (a) applying, running and providing the results of special usage and billing scripts for given products; (b) providing Relativity and its representatives with certifications respecting Named Users and usage metrics, and (c) granting remote supervised secure access to the Software for Relativity to verify billing and usage information.
Usage Reporting. Customer will provide information regarding Product licenses activated or deployed to Gigamon within five business days of any written request, so long as Gigamon does not make more than one request during any 12-month period. If Customer has used the Software in excess of the number of devices or other units of measurement permitted on the applicable Supplement, quote and / or purchase order, Customer will (i) promptly comply with this Agreement, and (ii) pay the additional fees due at the price previously agreed upon by the parties or Gigamon’s then-current list price if a price was not previously agreed upon.
