U.S. Export Control. ST understands and acknowledges that RPM is subject to regulation by agencies of the U.S. Government, including, but not limited to, the U.S. Department of Commerce, which prohibit export or diversion of certain products and technology to certain countries. Any and all obligations of RFM to provide RFM Materials or any media in which any of the foregoing is contained, as well as any other technical information and assistance shall be subject in all respects to such United States laws and regulations as shall from time to time govern the license and delivery of technology and products abroad by persons subject to the jurisdiction of the United States, including the Export Administration Act of 1979, as amended, any successor legislation, and the Export Administration Regulations issued by the Department of Commerce, Bureau of Export Administration. ST agrees to cooperate with RFM, including, without limitation, providing required documentation, in order to obtain export licenses or exemptions therefrom. ST warrants that it will comply with the Export Administration Regulations and other United States laws and regulations governing exports in effect from time to time.
U.S. Export Control. Nipro certifies that unless prior written ------------------- authorization is obtained from the U.S. Bureau of Export Administration or the U.S. Export Administration Regulations explicitly permit the re-export without such authorization, it will not export, re-export, or transship, directly or indirectly, the FreeStyle Products, documentation, technical assistance, or any media in which any of the foregoing is contained, or other technology provided hereunder or the direct product thereof, to any country as to which the U.S. Government has placed an embargo against the shipment of products, software or technology which embargo is in effect during the term of this Agreement.
U.S. Export Control. Distributor shall comply with all then applicable US export control laws and regulations in connection with its distribution of the Software and Documentation, and the disclosure of any technical information related thereto.
U.S. Export Control. You agree that the Pre-Release Software is subject to export control laws and regulations imposed by the U.S. Government, including the Dept. of Commerce Export Administration Regulations. You agree that you will not export nor re-export or provide access to, directly or indirectly, the Pre-Release Software in violation of such laws. You certify that you (i) are not identified on any U.S. Government export exclusion lists; (ii) will not provide the Pre-Release Software to any person or entity included on such lists; and (iii) will not use the Pre-Release Software in connection with chemical, biological, or nuclear weapons or missiles capable of delivering such weapons.

BUYER agrees to cooperate with Cirrus, including, without limitation, providing required documentation, in order to obtain export licenses or exemptions therefrom. BUYER warrants that it will comply with the Export Administration Regulations and other United States laws and regulations governing exports in effect from time to time.

Any and all obligations of EPIC to provide the Licensed program, documentation, or any media in which any of the foregoing is contained, as well as any other technical assistance shall be subject in all respects to such United States laws and regulations as shall from time to time govern the license and deliver of technology and products abroad by persons subject to the jurisdiction of the United States, including the Export Administration Act of 1979, as amended, any successor legislation, and the Export Administration Regulations issued by the Department of Commerce, Bureau of Export Administration. Customer agrees to cooperate with EPIC, including, without limitation, providing required documentation, in order to obtain export licenses or exemptions therefrom. Customer warrants that it will comply with the Export Administration Regulations and other United States laws and regulations governing exports in effect from time to time. Without in any way limiting the provisions of this Agreement, Customer agrees that unless prior written authorization is obtained from the Bureau of Export Administration or the Export Administration Regulations explicitly permit the re-export without such written authorization, it will not export, reexport, or transship, directly or indirectly, the Licensed Program or any technical data disclosed, or provided to Customer, or the direct product of such technical data, to country groups Q, S, W, Y, or Z (as defined in the Export Administration Regulations and which currently consist of Albania, Bulgaria, Cambodia, Cuba, the Czech Republic, Estonia, Laos, Latvia, Libya, Lithuania, Mongolian People's Republic, North Korea, Poland, Romania, the geographic area of the former Union of Soviet Socialist
U.S. Export Control. The Parties agree and acknowledge that in connection with their respective obligations under this Agreement, they shall at all times comply with the laws, rules and regulations of the United States regarding export restrictions, including, without limitation, the International Traffic in Arms Regulations, 22 CFR §§ 120-130. EBV shall in no circumstances be liable for any ----------------- damages, loss, or claim howsoever occasioned by an act or omission on the part of the Customer in Contravention of any regulations issued by the United States. Toho and Nanometrics understand that Nanometrics is subject to regulation by agencies of the U.S. Government, which prohibit export or diversion of certain technical products to certain countries.
