The UNLOADING AND LOADING clause defines the responsibilities and procedures for transferring goods onto and off of a vehicle, vessel, or other means of transport. It typically specifies which party—the buyer, seller, carrier, or another entity—is responsible for the physical handling, associated costs, and any risks during these operations. For example, the clause may state that the seller must load goods at the point of origin, while the buyer is responsible for unloading at the destination. This clause ensures clarity in logistics operations, helps prevent disputes over damage or delays, and allocates risk and cost appropriately between the parties involved.
UNLOADING AND LOADING. The Hirer shall be responsible for the unobstructed access and egress and, unless otherwise agreed in writing, for unloading and loading of the Plant at the site; and any personnel supplied by the Owner for such unloading and / or loading shall be deemed to be under the direction and control of the Hirer. Such personnel shall for all purposes in connection with their employment in the unloading and / or loading of the Plant be regarded as the servants or agents of the Hirer (but without prejudice to any of the provisions of clause 13) who shall be solely responsible for all claims arising in connection with unloading and / or loading of the Plant by, or with the assistance of, such personnel.

The Hirer shall be responsible for the unobstructed access and egress to the site, and where applicable any access road to the site and, unless otherwise agreed in writing, for unloading and loading of the Plant at the site or on the access road; and any personnel supplied by the Owner for such unloading and/or loading shall be deemed to be under the direction and control of the Hirer. Such personnel shall for all purposes in connection with their employment in the unloading and/or loading of the Plant be regarded as the servants or agents of the Hirer (but without prejudice to any of the provisions of clause 13) who shall be solely responsible for all claims arising in connection with unloading and/or loading of the Plant by, or with the assistance of, such personnel.
UNLOADING AND LOADING. The Supplier shall obtain permission from the Hirer’s Site representative before entering a Site and shall comply with the Contract Requirements - HSEA and any requirements in the Call-off Order regarding access to the Site. The Hirer shall otherwise be responsible for providing reasonable Site access and a safe area for unloading and loading to allow the Supplier to deliver and collect Plant. The Supplier shall be responsible for all unloading and loading of Plant and shall not interfere with or obstruct any public or private rights of way or property.
UNLOADING AND LOADING. 3.1 Where the Owner delivers or collects the Plant to the Site the Hirer shall be responsible for providing unobstructed access to the Site at the time specified by the Owner for delivery/collection and for providing a suitable space and surface for loading and unloading at the Site and, unless otherwise agreed in writing, for the unloading and loading of the Plant at the Site.
3.2 Where the Hirer agrees to collect the Plant the Hirer shall collect the Plant from the location and at the time specified by the Owner.
3.3 The Hirer shall pay to the Owner all reasonable costs incurred by the owner caused by failure of the Hirer to comply fully with the requirements set out in clause 3.1.

Such personnel shall for all purposes in connection with their employment in the unloading and / or loading of the Scaffolding be regarded as the servants or agents of the Contractor (but without prejudice to any of the provisions of clause 13) who shall be solely responsible for all claims arising in connection with unloading and / or loading of the Scaffolding by, or with the assistance of, such personnel.
UNLOADING AND LOADING. The Hirer assumes responsibility for facilitating unobstructed access, unloading, and loading of the Equipment at the site, unless otherwise specified. Any personnel provided by the Owner for these purposes shall operate under the direction and control of the Hirer.
UNLOADING AND LOADING. (a) The Hirer shall be responsible for and undertakes to (at its own cost);
i. provide the Owner with unobstructed access to the Site at the time agreed between the parties so as to facilitate the Delivery and Collection of the Plant (including unloading and loading) which shall occur by way of use of a heavy goods vehicle by the Owner unless agreed otherwise between the parties in writing;
ii. provide the Owner with adequate legal parking (including procuring and providing any necessary permit) for a heavy goods vehicle (or such other vehicle agreed between the parties in writing) at the Site to facilitate the Delivery and Collection of the Plant (including unloading and loading); and iii unless otherwise agreed in writing, unload the Plant at Delivery from and load the Plant at Collection onto the Owner’s delivery vehicle in accordance with this clause 4. For the avoidance of doubt, if the Hirer fails to comply with its obligations under this clause 4. (a) the Owner shall be entitled to immediately abort any Delivery or Collection and the Hirer shall be charged in full for such an aborted Delivery or Collection and for any further Deliveries or Collections carried out by the Owner (with such charges to include, but not be limited to any charges for illegal parking the Owner (or its representatives or sub-contractors) incur during Delivery or Collection).
(b) The Owner will automatically use a heavy goods vehicle for Delivery and Collection and the Hirer shall ensure it will comply with clause 4. (a) in respect of this vehicle type. The Hirer warrants that the Site is suitable for delivery by a heavy goods vehicle and to the extent the Hirer fails to notify the Owner that the Site is not suitable for a heavy goods vehicle and arrange an alternative vehicle for Delivery and/or Collection, it shall be liable for any aborted Delivery or Collection costs incurred. The Hirer shall also be liable for any additional costs incurred by the Owner in using any other vehicle type as a result of the Site being unsuitable for Delivery or Collection by a heavy goods vehicle.
(c) Without prejudice to the Hirer’s primary responsibility for loading and unloading the Plant at Delivery and Collection, any personnel supplied by the Owner for unloading and/or loading the Plant shall be deemed to be under the direction and control of the Hirer. e) The BBP & Council reserves the right to permit vehicles to enter and exit the pedestrianised area within these times for specific purposes. Any user who has been issued a key to the ▇▇▇▇▇▇▇ ▇▇ gate is required to close the gate, whenever their vehicle exists the Broadway. Any user not doing this is at risk of getting their vehicular access rights revoked.
