Trade Confirmation. Any information provided by the Fund Company or the Fund Agent to the Trust Entity electronically through Fund/SERV and pursuant to this Agreement, shall satisfy the delivery obligations as outlined by SEC Rule 10b-10 and, as such, the Fund Company has the informed consent of the Trust Entity to suppress the delivery of this information using paper-media. The Trust Entity will promptly verify the accuracy of confirmations of transactions and records received by the Fund Agent through Fund/SERV.
Trade Confirmation. Any information provided by ALPS or its designee to the Trust Entity electronically through Fund/SERV and pursuant to this Agreement, shall satisfy the delivery obligations as outlined by SEC Rule 10b-10 and, as such, ALPS or its designee has the informed consent of the Trust Entity to suppress the delivery of this information using paper-media. The Trust Entity will promptly verify accuracy of confirmations of transactions and records received by ALPS or its designee through Fund/SERV.
Trade Confirmation. A letter agreement executed by and between Countrywide and the Seller prior to the applicable Closing Date confirming the general terms and conditions of a prospective transaction contemplated herein and identifying certain loan characteristics of the Servicing Rights constituting the Servicing Rights Package to be purchased hereunder.
Trade Confirmation. Any information provided by the Trust or its designee to the Insurance Company electronically through Fund/SERV and pursuant to this Amendment, shall satisfy the delivery obligations as outlined by SEC Rule 10b-10 and, as such, the Trust and its designee have the informed consent of the Insurance Company to suppress the delivery of this information using paper-media. The Insurance Company will promptly verify accuracy of confirmations of transactions and records received by the Insurance Company through Fund/SERV. SETTLEMENT AND OVERPAYMENT
Trade Confirmation. Any information provided by the Distributor to the Company electronically through Fund/SERV and pursuant to this Agreement, shall satisfy the delivery obligations as outlined by SEC Rule 10b-10 and, as such, the Distributor has the informed consent of the Company to suppress the delivery of this information using paper-media. The Company will promptly verify accuracy of confirmations of transactions and records received by the Distributor through Fund/SERV.
Trade Confirmation. You acknowledge the electronic nature of our Services via our Online Trading Facility and the inherent risk that communications by electronic means may not reach their intended destination or may do so much later than intended for reasons outside our control. Accordingly, any Instruction sent by you or on your behalf via our Online Trading Facility or by e-mail shall only be deemed to have been received and shall only then constitute a valid Instruction and/or binding Contract between you and us, when such Instruction has been recorded as executed by us and confirmed by us to you through a Settlement/Trade Confirmation, and the mere transmission of an Instruction by you or on your behalf shall not by itself constitute a binding Contract between you and us.
Trade Confirmation. Any information provided by Janus Services to the Company electronically through Fund/SERV and pursuant to this Agreement, shall satisfy the delivery obligations as outlined by SEC Rule 10b-10 and, as such, Janus Services has the informed consent of the Company to suppress the delivery of this information using paper-media. The Company will promptly verify accuracy of confirmations of transactions and records received by Janus Services through Fund/SERV.
Trade Confirmation. The terms and conditions set forth in the Trade Confirmation and the Purchase Confirmation, each between the Purchaser and the Company, with respect to each Closing Date shall be incorporated herein. In the event of any conflict between the terms of this Agreement and the related Trade Confirmation, this Agreement shall control. In the event of any conflict among the terms of this Agreement, the related Trade Confirmation and the related Purchase Confirmation, the Purchase Confirmation shall control.
Trade Confirmation. A document evidencing the execution of the Order and the transfer of ownership rights from one party to the other in respect of the Financial Instruments. The Brokerage Company under its sole discretion determines the form of the Trade Confirmation.
Trade Confirmation. Any information provided by Fund Agent to Insurance Company electronically through Fund/SERV and pursuant to this Supplement, shall satisfy the confirmation delivery obligations as outlined by SEC Rule 10b-10. Insurance Company hereby provides its informed consent to suppress the delivery of this information using paper-media. Insurance Company will promptly verify the accuracy of confirmations of transactions and records received by Fund Agent through Fund/SERV.
